Scott H. Ruport

Mr. Ruport provides experienced litigation representation, and focuses his practice in the areas of commercial litigation, construction, real estate, zoning, eminent domain, surety, stocks and securities. Further, he has been involved in various complex matters relating to breach of fiduciary duty and fraud relating to trusts, partnerships and corporations; shareholder derivative actions; mortgage and mechanic lien foreclosure; ERISA; RICO; and, accounting malpractice.

 

Mr. Ruport's extensive trial experience started in 1974. In AFC Interiors v. DiCello (1989), 46 Ohio St. 3d 1, Mr. Ruport represented the plaintiff, and the Ohio Supreme Court changed 79 years of Ohio case law. The plaintiff appealed after losing in the trial court and the court of appeals. The Ohio Supreme Court reversed the decisions of the lower courts, holding that a section of the Uniform Commercial Code superseded the common law doctrine of accord and satisfaction in the "full payment" or "conditional-check" situation. In 1994, the Ohio Legislature added a section to the Ohio Uniform Commercial Code to change this case law result.

 

Mr. Ruport has been lead counsel in hundreds of trials and appellate cases. His goal is to make certain that the client's expectations are realistic and that the litigation process, with its risks, is clearly understood at the inception of the case.
